This document governs the use of the iMedia Sync application, including its local, remote, and widget features.

In this document, "the Company" refers to the owner and operator of the application, and "the User" refers to the person using it.

2. DATA THE APPLICATION MAY COLLECT

Depending on how the User uses the application, it may process the following types of information:
2.1 Account and profile data
- Account identifiers.
- User settings and preferences.
2.2 Technical and operational data
- Technical logs required for operation, security, error traceability, and service improvement.
- Device and linked computer information, limited to what is necessary to provide the service.
2.3 User-managed content data
- Files, thumbnails, metadata, and images that the User chooses to sync, back up, or access remotely.

3. PURPOSE OF DATA USE

Data is used exclusively to:
- Provide the contracted service and sync/transfer functionalities.
- Enable communication between computer and mobile device.
- Maintain security, prevent fraud, and resolve technical incidents.
- Improve application stability and performance.
Data will not be used for different purposes without the User's explicit consent when such consent is legally required.

4. USER CONSENT AND CONTROL

The Company undertakes not to use the User's personal data without explicit consent when applicable.
The User retains control over their information and may:
- Modify profile data when the app allows it.
- Revoke operating system permissions.
- Request complete deletion of profile information in accordance with section 10.

5. NO DISCLOSURE TO THIRD PARTIES

The Company does not share the User's personal data with third parties for commercial or advertising purposes.
User data is not sold.
Only technology providers strictly necessary to operate the infrastructure (for example, hosting or technical gateway services) may be involved, subject to confidentiality and security obligations, and with processing limited to service provision.

6. REMOTE FUNCTIONALITY, WIDGET, AND CLOUD USE AS A GATEWAY

6.1 Widget use and remote transfer
Using the widget employs cloud services as a temporary gateway between the computer and the device.
Information transferred through this route is uploaded encrypted E2E and deleted at the moment the transfer is completed.
6.2 Remote gallery
If the User accesses the remote gallery, the original image is uploaded temporarily to the cloud so it can be accessed by the iPhone.

6.3 Essential operational requirement
For remote communication to exist, the computer must be powered on and available.
If the computer is turned off, asleep, or without adequate connectivity, the remote function may not be available.

7. INFORMATION SECURITY

The Company applies reasonable technical and organizational security measures, including encryption in transit where applicable, access controls, and good protection practices.
However, no system is completely infallible.

8. LIMITATION OF LIABILITY AND WARNINGS
------------------------------------------------------------------
8.1 Possible failures
Like any other application, iMedia Sync may present errors, interruptions, or unexpected behavior.
8.2 Integrity review and backups
The User is strongly advised to:
- Regularly review the integrity of their files.
- Verify that backups and synchronizations are completed correctly.
- Maintain additional backup strategies.
8.3 Liability for content loss
The Company is not responsible for total or partial loss of the User's content, nor for indirect damages resulting from software, hardware, network, power failures, misuse, or causes beyond its reasonable control.
8.4 Storage quality and warranties
It is highly recommended to use high-quality storage media and monitor/record the warranty dates of such devices, replacing them preventively when necessary.

9. USER OBLIGATIONS

The User undertakes to:
- Use the application in accordance with the law and this document.
- Keep their devices updated and protected.
- Periodically check the status of their content and backups.
- Not use the application for unlawful purposes or to infringe third-party rights.

10. PROFILE DATA DELETION AND USER RIGHTS

If the User wishes to delete all profile information and associated data managed by the Company, they must request it explicitly by sending an email to:

The request must identify the account sufficiently so it can be processed securely.
The Company will process the request within a reasonable period in accordance with applicable regulations and current technical/legal limitations.

11. SUBSCRIPTION AND IN-APP PURCHASE INFORMATION

The application offers auto-renewable subscriptions and in-app purchases with the following terms:
11.1 Plans and pricing
The available plans (Rookie, Plus, Pro, Pro+ Family), their prices, and complete features are clearly displayed on the subscription screen within the application before making any purchase.
11.2 Subscription duration
Subscriptions are available in monthly or annual terms, depending on the chosen plan. The specific duration is clearly indicated on the purchase screen.
11.3 Auto-renewal
Subscriptions automatically renew at the end of each period (monthly or annual depending on the chosen plan) unless the User cancels auto-renewal at least 24 hours before the end of the current period.
The renewal charge will be made within 24 hours prior to the end of the current period, at the same price as the contracted plan (unless Apple notifies a price change in advance).
11.4 Free trial period
Some plans may offer a free trial period for new subscribers. The duration of the trial period is clearly indicated on the subscription screen.
If the User does not cancel the subscription before the trial period ends, the full price of the chosen subscription will be automatically charged.
Any unused portion of a free trial period (if applicable) will be forfeited when the User purchases a paid subscription before the trial period ends.
11.5 Subscription cancellation
The User can cancel auto-renewal at any time without penalty by accessing:
- iPhone/iPad Settings → [User Name at the top] → Subscriptions
- Or by visiting directly: https://apps.apple.com/account/subscriptions
Cancellation will take effect at the end of the current paid period. The User will continue to have access to premium features until the period they already paid for ends.
NO refunds are provided for the unused portion of the current period, except where expressly required by applicable law.
11.6 Payment management
Payment will be charged to the User's App Store account (linked to their Apple ID) upon purchase confirmation.
All payments are processed through Apple and are subject to Apple's App Store terms and conditions.
11.7 Plan changes
The User can change their subscription plan at any time from their Apple account subscription settings. The terms of the change (prorations, effective dates) are governed by Apple's policies.
11.8 Restore purchases
If the User reinstalls the application or uses a new device with the same Apple ID, they can restore their previous purchases using the "Restore Purchases" button available on the subscription screen.
11.9 Features by subscription level
The specific functionalities available at each subscription level (Rookie, Plus, Pro, Pro+ Family) are clearly detailed on the purchase screen, including storage limits, number of devices, access to premium features, etc.
The free plan (Rookie) offers limited basic functionalities without requiring payment.

12. INTELLECTUAL PROPERTY

The software, design, brand, documentation, and application components are the property of the Company or its licensors.
No exploitation rights are granted to the User other than those strictly necessary for authorized use of the application.

13. DOCUMENT MODIFICATIONS
------------------------------------------------------------------
The Company may update these terms for legal, technical, or service improvement reasons.
Where appropriate, the User will be informed through reasonable means within the application or official channels.
Continued use after an update implies acceptance of the current version.

14. APPLICABLE LAW AND JURISDICTION
------------------------------------------------------------------
This document shall be interpreted in accordance with the applicable regulations in the jurisdiction corresponding to the owner of the application and/or the mandatory consumer protection and personal data regulations applicable to the User.

1. IDENTIFICACIÓN Y ÁMBITO

El presente documento regula el uso de la aplicación iMedia Sync, incluyendo sus funciones locales, remotas y de widget.
Este texto integra:
- Política de Privacidad
- Términos y Condiciones de Uso
En este documento, "la Empresa" se refiere al titular y operador de la aplicación, y "el Usuario" a la persona que la utiliza.

2. DATOS QUE PUEDE RECOPILAR LA APLICACIÓN

La aplicación puede procesar, según el uso que realice el Usuario, los siguientes tipos de información:
2.1 Datos de cuenta y perfil
- Identificadores de cuenta.
- Configuración y preferencias de usuario.
2.2 Datos técnicos y operativos
- Registros técnicos necesarios para funcionamiento, seguridad, trazabilidad de errores y mejora del servicio.
- Información del dispositivo y de la computadora vinculada, limitada a lo necesario para la prestación del servicio.
2.3 Datos de contenido gestionado por el Usuario
- Archivos, miniaturas, metadatos e imágenes que el Usuario decida sincronizar, respaldar o consultar remotamente.

3. FINALIDAD DEL USO DE LOS DATOS

Los datos se utilizan exclusivamente para:
- Prestar el servicio contratado y las funcionalidades de sincronización/transferencia.
- Permitir la comunicación entre computadora y dispositivo móvil.
- Mantener la seguridad, prevenir fraude y resolver incidencias técnicas.
- Mejorar estabilidad y rendimiento de la aplicación.
No se utilizarán los datos para finalidades distintas sin consentimiento explícito del Usuario cuando dicho consentimiento sea legalmente exigible.

4. CONSENTIMIENTO Y CONTROL DEL USUARIO

La Empresa se compromete a no utilizar datos personales del Usuario sin su consentimiento explícito cuando corresponda.
El Usuario conserva control sobre su información y puede:
- Modificar datos de perfil cuando la app lo permita.
- Revocar permisos del sistema operativo.
- Solicitar la eliminación total de su información de perfil conforme al apartado 10.

5. NO CESIÓN A TERCEROS

La Empresa no comparte datos personales del Usuario con terceros para fines comerciales o publicitarios.
No se venden datos del Usuario.
Únicamente podrán intervenir proveedores tecnológicos estrictamente necesarios para operar la infraestructura (por ejemplo, alojamiento o pasarela técnica), sujetos a obligaciones de confidencialidad y seguridad, y con tratamiento limitado a la prestación del servicio.

6. FUNCIONALIDAD REMOTA, WIDGET Y USO DE NUBE COMO PASARELA
------------------------------------------------------------------
6.1 Uso del widget y transferencia remota
El uso del widget emplea servicios en la nube como pasarela temporal entre la computadora y el dispositivo.
La información transferida por esta vía se sube cifrada/encriptada extremo a extremo, nadie excepto el dueño del archivo puede acceder a su contenido y se elimina en el momento en que la transferencia se completa.
6.2 Galería remota
Si el Usuario accede a la galería remota, la imagen original sube temporalmente a la nube para que pueda ser accedida por el iPhone.
La información transferida por esta vía se sube cifrada/encriptada extremo a extremo, nadie excepto el dueño del archivo puede acceder a su contenido y se elimina en el momento en que la transferencia se completa.
6.3 Requisito operativo imprescindible
Para que exista comunicación remota, es imprescindible que la computadora esté encendida y disponible.
Si la computadora está apagada, suspendida o sin conectividad adecuada, la función remota puede no estar disponible.

7. SEGURIDAD DE LA INFORMACIÓN
------------------------------------------------------------------
La Empresa aplica medidas razonables de seguridad técnicas y organizativas, incluyendo cifrado en tránsito cuando proceda, controles de acceso y buenas prácticas de protección.
No obstante, ningún sistema es completamente infalible.

8. LIMITACIÓN DE RESPONSABILIDAD Y ADVERTENCIAS
------------------------------------------------------------------
8.1 Posibles fallos
Como cualquier otra aplicación, iMedia Sync puede presentar errores, interrupciones o comportamientos inesperados.
8.2 Revisión de integridad y copias
Se recomienda encarecidamente al Usuario:
- Revisar regularmente la integridad de sus archivos.
- Verificar que las copias y sincronizaciones se completan correctamente.
- Mantener estrategias adicionales de respaldo.
8.3 Responsabilidad por pérdida de contenido
La Empresa no se hace responsable de la pérdida total o parcial del contenido del Usuario, ni de daños indirectos derivados de fallos de software, hardware, red, energía, uso indebido o causas fuera de su control razonable.
8.4 Calidad del almacenamiento y garantías
Es muy recomendable utilizar medios de almacenamiento de alta calidad y monitorizar/registrar las fechas de garantía de dichos dispositivos, sustituyéndolos preventivamente cuando sea necesario.

9. OBLIGACIONES DEL USUARIO

El Usuario se compromete a:
- Usar la aplicación conforme a la ley y a este documento.
- Mantener sus dispositivos actualizados y protegidos.
- Comprobar de forma periódica el estado de su contenido y respaldos.
- No utilizar la aplicación para fines ilícitos ni para vulnerar derechos de terceros.

10. ELIMINACIÓN DE DATOS DE PERFIL Y DERECHOS DEL USUARIO

Si el Usuario desea borrar toda la información de su perfil y datos asociados gestionados por la Empresa, debe solicitarlo de forma explícita enviando un correo a:

La solicitud deberá identificar la cuenta de forma suficiente para poder tramitarla con seguridad.
La Empresa procesará la solicitud en un plazo razonable conforme a normativa aplicable y limitaciones técnicas/legales vigentes.

11. INFORMACIÓN SOBRE SUSCRIPCIONES Y COMPRAS DENTRO DE LA APP
------------------------------------------------------------------
La aplicación ofrece suscripciones de renovación automática y compras dentro de la app (In-App Purchases) con los siguientes términos:
11.1 Planes y precios
Los planes disponibles (Rookie, Plus, Pro, Pro+ Family), sus precios y características completas se muestran en la pantalla de suscripción dentro de la aplicación antes de realizar cualquier compra.
11.2 Duración de las suscripciones
Las suscripciones están disponibles en modalidad mensual o anual, según el plan elegido. La duración específica se indica claramente en la pantalla de compra.
11.3 Renovación automática
Las suscripciones se renuevan automáticamente al final de cada período (mensual o anual según el plan elegido) a menos que el Usuario cancele la renovación automática al menos 24 horas antes del final del período actual.
El cargo por la renovación se realizará dentro de las 24 horas previas a la finalización del período actual, al mismo precio del plan contratado (salvo que Apple notifique un cambio de precio con antelación).
11.4 Período de prueba gratuito
Algunos planes pueden ofrecer un período de prueba gratuito para nuevos suscriptores. La duración del período de prueba se indica claramente en la pantalla de suscripción.
Si el Usuario no cancela la suscripción antes de que finalice el período de prueba, se cobrará automáticamente el precio completo de la suscripción elegida.
El período de prueba gratuito no utilizado (si aplica) se perderá cuando el Usuario compre una suscripción de pago antes de finalizar el período de prueba.
11.5 Cancelación de suscripciones
El Usuario puede cancelar la renovación automática en cualquier momento sin penalización, accediendo a:
- Ajustes de iPhone/iPad → [Nombre del Usuario en la parte superior] → Suscripciones
- O visitando directamente: https://apps.apple.com/account/subscriptions
La cancelación entrará en vigor al final del período actual ya pagado. El Usuario seguirá teniendo acceso a las funciones premium hasta que finalice el período por el que ya pagó.
NO se realizan reembolsos por la parte no utilizada del período en curso, salvo cuando la ley aplicable lo exija expresamente.
11.6 Gestión del pago
El pago se cargará a la cuenta de App Store del Usuario (vinculada a su Apple ID) en el momento de confirmar la compra.
Todos los pagos se procesan a través de Apple y están sujetos a los términos y condiciones de la App Store de Apple.
11.7 Cambio de plan
El Usuario puede cambiar de plan de suscripción en cualquier momento desde la configuración de suscripciones de su cuenta de Apple. Los términos del cambio (prorratas, fechas de aplicación) se rigen por las políticas de Apple.
11.8 Restauración de compras
Si el Usuario reinstala la aplicación o utiliza un nuevo dispositivo con el mismo Apple ID, puede restaurar sus compras previas utilizando el botón "Restaurar Compras" disponible en la pantalla de suscripciones.
11.9 Funciones por nivel de suscripción
Las funcionalidades específicas disponibles en cada nivel de suscripción (Rookie, Plus, Pro, Pro+ Family) se detallan claramente en la pantalla de compra, incluyendo límites de almacenamiento, número de dispositivos, acceso a funciones premium, etc.
El plan gratuito (Rookie) ofrece funcionalidades básicas limitadas sin necesidad de pago.

12. PROPIEDAD INTELECTUAL

El software, diseño, marca, documentación y componentes de la aplicación son propiedad de la Empresa o de sus licenciantes.
No se concede al Usuario ningún derecho de explotación distinto del estrictamente necesario para el uso autorizado de la aplicación.

13. MODIFICACIONES DEL DOCUMENTO

La Empresa podrá actualizar estos términos por motivos legales, técnicos o de mejora del servicio.
Cuando proceda, se informará al Usuario por medios razonables dentro de la aplicación o canales oficiales.
El uso continuado tras la actualización implica aceptación de la versión vigente.

14. LEY APLICABLE Y JURISDICCIÓN

Este documento se interpretará conforme a la normativa aplicable en la jurisdicción que corresponda al titular de la aplicación y/o a la normativa imperativa de protección del consumidor y de datos personales aplicable al Usuario.
